Advertisements service VISITMYHOME.EU Terms and Conditions of Use
1. By submitting an advertisement, the user fully agrees with these terms and conditions of use of the service, as well as the fact that his personal and contact information will be stored in the database of the VISITMYHOME.EU advertisement service in accordance with the law.
2. Service VISITMYHOME.EU uses cookies located on the user’s computer. The VISITMYHOME.EU service uses third-party advertising serving systems such as Google and statistics systems that also generate cookies. You can delete cookies by yourself in your web browser at any time.
3. The administration of the advertisement service due to the need to prevent the illegal circulation of excise and controlled goods, medicines, weapons, hazardous and harmful substances, as well as to prevent the offers of services licensed by the state without a valid license, for financial discipline and accounting purposes to prevent tax evasion, money laundering and other violations of the law may identify persons and companies by requesting additional information and documents.
All documentation, information about the person and confidential information are stored in the minimum required amounts and for the minimum necessary time.
The numbers of employees who have access to this information are strictly limited; employee queries for data are recorded in logs before access to documents.
Advertisement content rules:
5. Advertisements will not be accepted (deleted) if:
5.1 Breaking laws or generally accepted norms of behaviour and ethics. The advertisement in which the required fields are not filled in or filled in incorrectly, or contain incorrect, erroneous information.
5.2 Content does not match or only partially matches the selected section. If there is no suitable section, then it is allowed to submit an advertisement in the section that most closely matches the topic, but the type of deal must be selected “Miscellaneous”.
5.3 Advertisement without an accurate detailed description of the offered product, service or vacancy, which do not contain important details (for example, product quality, condition, material, dimensions, functionality, nuances of use, areas of acceptable use) and it is impossible to determine the specified details from the photo, or when the text or the photo is misleading about the above.
Examples of violations:
– The advertisement for the sale of a car does not indicate that the car was previously involved in a car accident.
– The advertisement for the sale of furniture does not mention the information that the photo contains parts of the furniture that are not included.
– The advertisement for the sale of real estate does not indicate the status and condition of the object, or photos are not attached.
5.4 Contains more than one sales item or service, or the text content is general (e.g. “Any notebook”, “Different models”, etc.) In each advertisement, it is allowed to publish an offer of only one specific product or service with an exact price and a detailed description. In the attached photos, it is allowed to show only one specific product described in the advertisement.
5.4.1 With the types of deal Miscellaneous, Make and Repair is allowed to place advertisements without taking into account the requirements of clause 5.4.
5.5 With an offer of non-existent (in the territory of Estonia) goods or services.
Examples:
”Toyota Camry 2020 mileage 19 thousand, the car is located in France”
“The apartment is in a building under construction”
5.6 The text of the advertisement (except for fields for this purpose) or attached graphics contains the phone number, email, link, or other contact information.
5.7 The price stated in the advertisement does not correspond to reality or additional obligatory expenses are not indicated. The price in the advertisement must be final without any additional conditions.
Examples:
– the new phone Samsung galaxy s21 is on sale, price by agreement – (the price stated in the corresponding field is 20€).
– the tour price shown does not include the cost of the flight.
– the specified price does not include VAT (applies to legal entities)
– the price for renting an apartment or car or boat for 1 day is specified 40€, but the minimum possible rental period starts from 2 days.
5.8 It’s not allowed to use the photos:
– low quality when the condition of the object is not visible.
– general view, where the object of sale is presented along with other objects and is not dominant.
– not corresponding to the object in the advertisement. Only the product described in the advertisement text should be visible in the photos. Photos must be real, but not from catalogs or found on the internet.
– containing too bright background, unnatural colors or other elements to attract attention in the general list of advertisements.
– containing captions or elements that interfere with viewing and changing the natural aesthetic appearance of the image.
– with logos, contact information or addresses.
– photo collages where several photos are combined into one.
5.10 In the first line of the text of the advertisement, the words or parts of words are highlighted in capital letters using «Caps Lock».
Examples: “Selling NEW Harley Davidson motorcycle”, “Renting Apartment At a Bargain Price.”
5.11 Containing service characters, extra spaces, periods, a set of repeated letters, as well as information that is not related to the product description.
Example: “Sell // car // lexus”.
5.12 The first line contains the words Promotion, Sale, Special offer, Unique prices, Super offer, Attention, New and other marketing phrases designed to attract the attention of users in the general list of advertisements. Also, the first line of the advertisement contains information that is not related to the product description, such as the name of the store, address, etc.
5.13 In any way infringing copyright or trademark rights.
5.14 The advertisement is written in languages other than Estonian, Russian or English; contains text in Russian but written in Latin letters. Contains many errors in the text.
5.15 A full or partial prepayment is required for the product or service offered.
5.16 The advertisement is intended to obtain information about the user.
5.17 Advertisements that receive multiple complaints.
5.18 With offers of licensable goods or services, if the advertisement does not contain the exact contact information of the seller and the corresponding license number.
5.19 Contains offers for work in video chats, erotic video and photo sessions or sex services in any form.
5.20 Distribution of medicines, goods or services through network marketing MLM. About making money on the internet through registrations, clicks, views or other questionable activities.
5.21 The offer of tobacco products, smoking accessories, alcohol, precursors, controlled drugs, dangerous or harmful substances and products, as well as equipment for the production and processing of these items.
5.22 In multiple advertisements, the internet link opens the first page of the user’s website. It’s allowed to use a link that opens a web page with a description of the product, which is offered in the advertisement.
5.23 The advertisement is from employment agencies or recruitment companies, from auctions, or other advertisement services are advertised. Also, text or photos contains logos or links related to the above organizations. Links to other advertisement services are not accepted for publication.
5.24 With the offer of services of an occult nature: astrology, fortune telling, alternative medicine, etc., as well as advertisements for tattooing and piercing.
5.25 Contains an offer for a collection of deposits, donations, contributions and other investments in any form.
5.26 Advertisement for employment abroad of Estonia.
5.27 Containing links to resources that incorrectly serve visitors, open pop-up windows, include sound or perform other inappropriate actions affecting visitors, or resources of information systems that contain offers of goods or services that are not allowed to be placed in VISITMYHOME.EU advertisement.
For example:
– The advertisement includes a link to a site that offers smoking devices, even if the advertisement does not mention information about these devices.
– Clicking on the link opens a page inviting you to register or fill in a questionnaire or survey.
– Clicking on the link opens a completely different page than the one indicated in the advertisement (redirection) or opens an additional page (PopUp or PopUnder).
5.28 Contain a link to pages that are not related to the subject of the advertisement, as well as to pages with little information, outdated content or extremely poor quality, or overloaded with internet counters, advertisement blocks or links to other pages.
5.29 Contain text with emotional connotation, exclamations, calls, slogans, declarations, posed questions, as well as text and keywords that are not related to the object of the advertisement. The use of exclamation marks, question marks or other symbols to attract attention is not allowed. The text of the advertisement must contain only informative content.
5.30 Advertisements for the sale of a car with an odometer that has been reduced or incorrectly indicated; with photos in which the number plates have been hidden or replaced, or without Estonian number plates at all; as well indicating a different year of manufacture or other fraudulent actions.
5.31 Repeatedly repeated advertisements with the same content or containing the same links. When placing multiple advertisements, the text for each must be unique.
5.32 Advertisement aimed at distributing unsolicited correspondence and advertising brochures or associated with other interfering advertising methods or aggressive marketing.
5.33 The offered service or product has no value (demand) or the advertisement has absurd content.
Organization of order:
6.1 Change or edit the advertisement after the start of publication is not possible.
6.2 In case of violation or non-compliance with the terms of use of the advertisements service VISITMYHOME.EU, referred in paragraph 5, an administrator is obliged to delete the advertisement.
Fee for checking and deleting incorrect advertisement – 2 € for each advertisement.
The residual worth of advertisement for left full days of publication is returning to the user VISITMYHOME.EU account.
In case of repeated violations, the user may be restricted from accessing VISITMYHOME.EU advertisements service.
6.3 A user, a company, association or group of persons posting advertisements in common interest is allowed to register no more than one registration (account).
6.4 The advertisement will be published no later than within one hour from receiving payment. The term for placing the advertisement is chosen by the user and depends on the chosen section (minimum term one day, maximum term eight weeks).
6.5 The price of placing an advertisement depends on the chosen section, the selling price of the product or service, the term of placing the advertisement and the method of payment.
The cost of all services of the VISITMYHOME.EU advertisements services includes host country VAT (for example Estonia 20%). The publication of advertisements is a service provided in the territory of Estonia, therefore payment of VAT (20%) is obligatory, including for non-residents of Estonia.
Liability of the parties:
7.1 If the VISITMYHOME.EU site is down temporarily, advertisements publication term are extended for the period of unavailability of the service. This provision does not apply if the service was not available by the part of the network administered by providers that are not bound by contracts and obligations with the VISITMYHOME.EU advertisements service.
7.2 In cases when the advertisement violates the rules of the site, contains violations of the law of the Republic of Estonia, copyright, trademark law, as well as if damage or inconvenience is caused to third parties, the user (advertiser) carries full financial responsibility for the content of the advertisement posted by him to the advertisements service and third parties.
7.3 The company, the administrator, as well as the owner of the advertisements service VISITMYHOME.EU are not responsible for the content of the advertisements, as well as for possible losses and inconveniences related to the operation or unavailability of the site, except for paragraph 3
7.4 If a user violates the advertisements service VISITMYHOME.EU terms and conditions of use, a warning is issued regarding the first violation by removing the posted advertisement (payment for the removed advertisement is not refundable). In the event of a repeated violation within a year, the VISITMYHOME.EU administration has the right to apply a ban on the publication of advertisements for a period up to a year. If user, after applying the ban, continues to use the account of another user to publish advertisement or similarly tries to evade the applied ban, the advertisement will not be published (will be removed). VISITMYHOME.EU advertisement service is not responsible for any losses that the author of the advertisement inflicts on third parties.
7.5 Commercial users do not have access to personal data and/or other data (also in aggregate form), which are provided to the VISITMYHOME.EU advertisement service or used to provide services to commercial users of the VISITMYHOME.EU advertisement service and their consumers.
7.6 ”Apptechdeveloper OÜ” has access to personal data provided by commercial users or consumers in order to use the services of the VISITMYHOME.EU advertisement service. Apptechdeveloper OÜ”VMH” does not share or disclose personal data to third parties. The purposes and terms of the processing of personal data are included in the Privacy policy.
Changes to terms and conditions:
8. Advertisements service VISITMYHOME.EU The Terms and Conditions of Use may be changed, supplemented or amended and take effect as soon as they are posted on the site.
8.1 Commercial users are informed about changes in the terms of use 15 days before their entry into force, and these changes take effect within 15 days from the date of notification of commercial users (including on the VISITMYHOME.EU website). In cases where commercial users need to make technical or commercial actions in order to ensure compliance with changes, the effective date of these changes can be more than 15 days with the mention of this period in the changed rules.
8.2 The respective commercial user has the right to terminate the contract with the online service provider VISITMYHOME.EU within 15 days prior to the entry into force of the change to the terms of use. Termination of the agreement takes effect within 15 days from the date of notification to the administration website VISITMYHOME.EU about the termination of cooperation.
8.3 The commercial user has the right to waive the notice period by informing the VISITMYHOME.EU administrator about it by means of a written statement, or by any means of clearly expressed action.
